Legionella Liability: Who Are Those at the Greatest Liability Risk?

In the matter of a Legionnaires’ disease outbreak, there are many potential parties who may be held liable and, as such, can become targets of a legal action.

In most cases, that Legionnaire’s outbreak liability falls on the owners, operators, and managers of the facility or premises where the outbreak occurred. That may be a hotel, a hospital, a senior housing facility, a condominium complex, or an apartment building. These parties have an obligation to do everything in their power to protect the occupants of their premises from known hazards, such as Legionella. This includes having proactive Legionella risk assessments, Legionella testing, and Legionella mitigation/remediation.
